In June 2010 a taxi driver in India got stopped by the police. When this happened the two people in the back of his car ran away. After they left the police found 20 kilos of ganja in the car, in two bags you could see. Since the driver was the only one left he got arrested and charged with drug crimes.
The main problem for the driver was that he couldn’t say who the passengers were. He said he didn’t know them or about the drugs but he was kept in jail for seven years because of it. The big legal question was if the driver being unable to give information meant he was involved in drug dealing.
Finally the Supreme Court said the driver was not guilty. They said the police didn’t prove he had anything to do with the drugs. Just because he was driving the car with the drugs and didn’t know the passengers they decided that wasn’t enough to say he was guilty. The court made it clear you can’t punish someone just because they don’t know who their passengers are.
