Madras High Court Rules Wife's Stay at Parents' Home During Husband's Absence Is Not Desertion

The Madras High Court recently ruled that a wife staying at her mother's home for childbirth and remaining there afterward does not amount to desertion, especially when the husband was abroad during that period. The court emphasized that the wife had no choice but to seek support from her parents during pregnancy and delivery, particularly since the husband was not present in India.

The bench, comprising Justice CV Karthikeyan and Justice K Rajasekar, dismissed the husband’s divorce petition filed under the Hindu Marriage Act. The husband had alleged mental cruelty and desertion, claiming the wife left the matrimonial home after he moved to Singapore seven months post-marriage. He also accused her of maintaining inappropriate contact with another man—a claim the court found baseless and damaging.

The court noted that such false allegations would naturally cause emotional distress, making reconciliation difficult. It held that the wife’s decision to remain at her mother’s house was a direct consequence of the husband’s neglect and unfounded accusations, not an act of desertion.

Additionally, the court observed that the husband sent all his earnings to his mother rather than supporting his wife financially. This failure to maintain his spouse justified her seeking maintenance through legal means. The court stressed that after marriage, the husband had a duty to establish a separate household and provide for his wife, which he failed to do.

Given these circumstances, the court concluded that the wife’s actions were reasonable and that the marital issues were minor. It dismissed the husband’s appeal, stating he could not exploit his own shortcomings to seek divorce. The judgment underscores the importance of spousal support and accountability in marriage.
