  • Yasin Malik identified by an eyewitness as the primary shooter in the 1990 Srinagar IAF personnel shooting incident.

Yasin Malik identified by an eyewitness as the primary shooter in the 1990 Srinagar IAF personnel shooting incident.

On January 25, 1990, near Rawalpora, on the outskirts of Srinagar, Rajwar Umeshwar Singh, an IAF personnel waiting for the staff pickup van, saw a man take out a gun from under his ‘pheran’ and shoot fire, killing four soldiers. Rajwar, a survivor and key prosecution witness, positively recognised the shooter as Yasin Malik 34 years after the terrorist incident.

SRINAGAR: On January 25, 1990, Rajwar Umeshwar Singh witnessed a man draw a revolver from under his “pheran” and start fire on a group of IAF personnel who were waiting for the staff pickup bus at Rawalpora on the outskirts of Srinagar. Four soldiers were killed in the incident. The gunman was identified as Yasin Malik, the leader of the banned Jammu Kashmir Liberation Front (JKLF), by survivor and important prosecution witness Rajwar on Thursday, 34 years after the terrorist attack.

Deposing before a special CBI court in Jammu, the former IAF corporal pointed at Malik, who was attending the proceedings via video-conferencing from Delhi’s Tihar Jail, where he is serving life sentence in a terror funding case since 2019.

Malik was offered the chance to cross-examine the eyewitness, but he declined and insisted on being present in person for the hearing.

The next hearing was scheduled for February 15 by the court.
According to CBI attorney Monika Kohli, Malik’s identification by the eyewitness as the primary gunman was a major boost for the prosecution.

In addition to the four IAF men who were slain, Malik and a few other JKLF agents also caused injuries to twenty-two other individuals in the terror strike.

CBI filed a chargesheet against Malik and others before the designated TADA court in Jammu on August 31, 1990.

In March 2020, the special court framed charges against the JKLF chief and six others — Ali Mohammed Mir, Manzoor Ahmed Sofi alias Mustafa, Javaid Ahmed Mir alias Nalka, Showkat Ahmed Bakshi, Javed Ahmed Zargar and Nanaji.

Malik is also an accused in the 1989 abduction of Rubaiya Sayeed, daughter of then Union home minister Mufti Mohammad Sayeed. Rubayia had also recognised him, along with three others, as her kidnappers, in a TADA court in July 2022.

New Manipur violence results in the deaths of two police officers and three injuries.

On Wednesday, militants attacked several security installations simultaneously in Manipur’s Moreh township, which borders Myanmar. Two police commandos were killed and three others were injured in the attack, which involved rocket-propelled grenades and nonstop gunfire. Tengnoupal district, the scene of Manipur’s worst violence since the end of the previous year, was the backdrop against which the tragedy took place. Several houses there were on fire.

IMPHAL: In a repeat of their shock-and-awe attack, militants launched simultaneous attacks on several security outposts in Manipur’s Moreh township, which borders Myanmar, early on Wednesday. Two police commandos were killed and three others were wounded.

In the conflict-torn township of Tengnoupal district, the heart of violence in Manipur since the end of last year, several buildings were on fire as part of a concerted onslaught that included rocket-propelled grenades and ceaseless gunfire.

According to sources, two fire engines from nearby Myanmar crossed the border and put out the fires that were consuming residences at Kanan Veng in Moreh Ward 3 and another group of homes close to Moreh Hospital.
Many women protested in the streets of Imphal as word of the fatalities spread, accusing the BJP-led government of failing to stop the militants who were constantly targeting security troops in the slum.

Police halted some of them as they tried to attack the mansions of Governor Anusuiya Uikey and Chief Minister N Biren Singh.
The attacks happened the day after two Moreh locals, Philip Khongsai and Hemkholal Mate, were remanded in detention for nine days for the murder of subdivisional police officer Chingtham Anand last year.

Havildar Takhellambam Saileshwor of the 1st India Reserve Battalion was one of the dead commandos. He was the custodian for the Manipur Police Sports Club team and was from Lamsang in the Imphal West division. Wangkhem Somorjit Meitei of the 6 Bn of the Manipur Rifles was the other casualty.

Around nine in the morning, while on a group video call, our uncle Saileshwor informed us that his group was being attacked in Moreh, with gunfire and bombs coming from all directions. According to him, one of his comrades was hurt prior to the conversation concluding,” stated Prashanta Takhellambam, the late commando’s nephew.

After a hiatus, he had departed home for Moreh on January 5, according to Prashanta.
Residents of Malom formed a joint action committee to protest Somorjit’s killing, however the committee agreed not to accept his remains until the government apprehended those accountable for his death.

The home department requested helicopter support from the Centre in response to a “emergency requirement” that arose in Moreh. “The law-and-order situation in the border town has become a matter of serious concern,” Home Commissioner T Ranjit wrote in a letter to MHA.

  • Bilkis Bano Case: Rape convicts in the Bilkis Bano case petition the Supreme Court for an extension of time to surrender, citing their poor health.

Bilkis Bano Case: Rape convicts in the Bilkis Bano case petition the Supreme Court for an extension of time to surrender, citing their poor health.

On January 8, the Supreme Court issued an order for the prisoners to appear before the jail administration in two weeks.

Govindhbhai Nai, a prisoner in the Bilkis Bano gang rape case, has petitioned the Supreme Court to be given an extra four weeks to turn himself in to the relevant jail authorities.

Nai and ten other prisoners were given a two-week deadline by the Supreme Court to turn themselves in to the jail administration on January 8.

In his appeal for an extension, Nai mentioned his poor health as well as his household duties.

Nai’s father is reliant on him and confined to bed, according to the appeal.

In addition, he disclosed that he recently had an angiography and still needs to have another procedure to treat “haemorrhoids.”

The eleven defendants in front of the supreme court were found guilty of killing Bilkis Bano’s family members and raping her during the 2002 Gujarat riots.

These prisoners were freed early from prison on August 14, 2023, the eve of Independence Day, without having to serve out the remainder of their term.

Following a May 2022 ruling by the Supreme Court holding that a remission application should be reviewed in accordance with the policies of the State where the crime was committed—Gujarat in this case—rather than the State where the trial was held, the Gujarat government approved the remission of their sentence.

Even though the case’s trial was held in Maharashtra, the Gujarati government used its remission policy in accordance with that ruling to free the guilty.

Several petitioners, including Bano, contested the Gujarat government’s judgement before the highest court.

On January 8, a bench of Justices BV Nagarathna and Ujjal Bhuyan of the Supreme Court invalidated the remission that the Gujarati government had given them. It came to the conclusion that the Gujarati government lacked the authority to grant these eleven prisoners remission under its policy.

Thus, it ordered all eleven to turn themselves in within two weeks.

Update: Two more prisoners have petitioned the Supreme Court to extend their deadline for turning themselves in.

Ramesh Rupabhai Chandana, a convicted felon, has requested an additional six weeks to extend his sentence, citing the need to marry his son and meet his obligations.

In addition, convicted felon Mitesh Chimanlal Bhat has requested a six-week extension, claiming that his winter produce is ready for harvesting and that he would prefer to finish the process before turning himself in.

  • Mahua Moitra Responds to Center’s Eviction Notice, Warning Against “Use of Force”

Mahua Moitra Responds to Center’s Eviction Notice, Warning Against “Use of Force”

Mahua Moitra Case: The action was taken more than a month after Mahua Moitra was dismissed from the Lok Sabha for unethical behaviour.

New Delhi: Mahua Moitra, the leader of the Trinamool Congress, is scheduled to appear before the Delhi High Court today to contest a notice that demands her to leave the government house she was given as an MP and threatens to “use force” if necessary, NDTV has learned from sources.

The leader of Trinamool, who was removed from office as a Lok Sabha MP last month due to unethical behaviour, would soon file a writ suit in the court of Justice Manmohan challenging the eviction notice.

According to Ms. Moitra’s solicitors, she is running for the Lok Sabha elections. From the final day of the Parliament session preceding a general election until the day of results, MPs are permitted to remain in their residences, they have stated. They have contended that since Ms. Moitra has been listed as a candidate, this ought to also apply to her.

The Centre has sent Ms. Moitra an eviction notice with severe language asking her to leave the cottage right away. The Directorate of Estates, which oversees government assets, has sent out a letter stating that Ms. Moitra and any other occupants “are liable to be evicted from the said premises, if need be, by the use of such force as may be necessary” if she does not leave on her own.

Ms. Moitra was “allowed sufficient opportunity,” according to the government’s notification, but she was unable to provide evidence that she is not an unauthorised occupant.

Ms. Moitra had previously filed an appeal with the top court. She was then instructed by the court to seek the Directorate of Estates for permission to temporarily occupy the bungalow. The court had observed that in certain extraordinary cases, regulations allowed authorities to grant a resident a six-month overstay in exchange for payment of specific fees.

However, the court let Ms. Moitra to withdraw her petition without commenting on the case’s merits.

According to the eviction order, Ms. Moitra will have to pay damages for each month if she chooses to contest the eviction notice in court.

Ms. Moitra lives in a home on Telegraph Lane in Delhi. Days after being removed from office as an MP, on December 11, Ms. Moitra received a letter from the Directorate of Estates asking her to leave the property by January 7.

Prior to this year’s Lok Sabha elections, Ms. Moitra had requested more time. She had claimed that her campaign will be hampered by the current loss of government housing.

In December, Ms. Moitra was dismissed from her position as a Lok Sabha member after a parliamentary panel found her guilty of unethical behaviour for taking lavish gifts from a businessman and giving him access to her Parliament login credentials.
