HC slammed farmers: “Can’t use tractor trolley on highway”

The protesting farmers have received criticism from the Punjab and Haryana High Court. The court questioned the use of tractor trolleys in the protests during the hearing. Farmers have other options if they wish to demonstrate in a nonviolent manner. In addition, he asked the Punjabi government, “Why are you letting the farmers congregate?”

Right to Protest but with Restrictions

“They have the right to protest, but it is subject to appropriate restrictions,” the court ruled. The Centre informed the High Court during the hearing that a meeting was held to discuss the demands of the agitated farmers.

The central government was questioned by the court regarding the proceedings of the meetings and asked to submit a fresh affidavit with all of the details. The hearing was postponed until next week by the High Court.

The High Court was informed on Thursday by Additional Solicitor General Satyapal Jain that another meeting between Union Ministers and representatives of farmers’ organisations has been scheduled. Many people are optimistic that this meeting will result in a resolution to the issue. Regarding this, the High Court had stated that no orders should be made until after the conclusion of this meeting. The High Court has scheduled this case’s hearing for Tuesday in light of the circumstances. With the status report, each defendant must be present today.

ACJ Sandhawalia also expressed disapproval of farmers traveling in tractors and trolleys to demonstrate during the hearing. “According to Motor Vehicle Act, you cannot use tractors and trolleys on highway…you are travelling on your tractors and trolleys from Amritsar to Delhi…everyone knows about their rights but there are also constitutional duties,” the ACJ stated.

  • Mayor election votes are counted again and AAP candidate wins

Mayor election votes are counted again and AAP candidate wins

A significant ruling about the Chandigarh mayoral election has been rendered by the Supreme Court. The court has mandated that the votes that were cast in the mayoral election be recounted. Upon reviewing the ballots, the bench headed by the Chief Justice concluded that 8 votes in favour of AAP candidate Kuldeep Kumar were deemed invalid.

The Aam Aadmi Party can now become the mayor of Chandigarh as a result of this. The court declared that it would order a recount of the votes in the mayoral election. Not only this but the eight votes that were not accepted should also be regarded as invalid.

On Tuesday, the Supreme Court held a noteworthy hearing regarding this case. The Chief Justice displayed the ballots to the attorneys and onlookers, stating that Kuldeep Kumar was stamped on each of the eight ballots that were ruled void. Anil Masih drew the line on these voting papers, according to the court. The court further questioned why the line was drawn and they were declared illegal when there was no irregularity.

In response, Anil Masih’s attorneys claimed that the voting had taken place in a less cordial environment. Anil Masih thought that in this case, these individuals might have been falsifying the ballots and escaping with them.

Supreme Court did not find Anil Masih’s reasoning good to withstand.

Anil Masih grabbed the ballot papers in this scenario, crossed them out, and declared them void.
The supreme court, however, did not appear to be pleased with his defence. We would like to inform you that three Aam Aadmi Party councillors have joined the BJP following the mayoralty elections.

If elections had been held again in that scenario, the only party that could have won mayor was the BJP.

After Supreme Court intervention AAP’s candidate becomes the Mayor of Chandigarh

On Tuesday, February 20, the results of the Chandigarh mayoral election were overturned, and Kuldeep Kumar, the candidate of the AAP-Congress alliance, was declared the victor.

This occurred the day after the Supreme Court ruled that the current ballots from the contentious election would be used to determine the results rather than conducting a recount. The court declared that it would review the ballots and the full video recording of the counting day on Tuesday.

Why was the Chandigarh Mayor election significant?

The Chandigarh municipal election was significant because it was the first time that the Congress and the Aam Aadmi Party (AAP) had ever allied. In order to create the conditions for future alliances in other states during the Lok Sabha elections, the combine sought to challenge the BJP.

    Who is Anil Masih?

In October 2022, Anil Masih, the former general secretary of the minority morcha cell for the BJP, was nominated as a councillor. A few days prior to the SC hearing, the BJP removed his name from the minority cell. Masih, a 53-year-old resident of Chandigarh’s PEC campus, has experience in marketing. His wife and two sons are part of his Ambala-born family.

    What happened during the election?

With 16 votes, Sonkar won, and the alliance between the AAP and Congress received 12 votes. Masih declared eight votes invalid. Masih was accused by the Opposition of unfairly invalidating votes. They used videos purporting to show his meddling with voting papers to approach the Supreme Court as well as the High Courts of Punjab and Haryana.

How did the numbers stack up before the election?

In the Municipal Corporation, the AAP had thirteen council members and the Congress had seven. This resulted in an advantage of 20 out of the 35 members of the House. Thanks to the votes of the Chandigarh MP, an ex officio member of the House, and its 14 council members, the BJP received 15 votes. The MP for Chandigarh is Kirron Kher of the BJP. The House has one councillor from Akali Dal, a former BJP ally. Every year, the city’s elected council members choose the Chandigarh Mayor, who holds a one-year term.

In addition to announcing his new party’s formation, Swami Prasad Maurya resigned as general secretary. He can also take out a lot of SP MLAs.

“I had the chance to work in a friendly atmosphere under your direction,” Maurya remarked. I disagree with Akhilesh Yadav on philosophical grounds, declared Swami Prasad Maurya upon leaving the SP. No one is subject to discrimination. The ideology of socialism is opposed by Akhilesh Yadav. I’ll make my next travel decision on February 22.

  • Supreme Court prosecuted Anil Masih after he accepted putting marks on ballot

Supreme Court prosecuted Anil Masih after he accepted putting marks on ballot

On February 19, the Supreme Court held the hearing for the Chandigarh Mayor election case where the Returning Officer Anil Masih was under heavy scrutiny by CJI Chandrachud. The question about the marking on the ballot papers just kept going on with CJI also stating that Masih should be prosecuted for his actions.

In response, Returning Officer Anil stated that he was signing the ballot paper rather than destroying it. In response, the CJI informed him that it was evident from the video that you were annotating the ballot paper. You don’t have the legal authority to do this, he criticised Anil and said he should be prosecuted.

Manoj Sonkar, the BJP candidate, won the election as a result of eight ballot papers that the returning officer is alleged to have tampered with. “Every ballot paper had marks on it. There were numerous cameras that I was just looking at them.” He also added that he marked ballots with an “X” to make sure they did not get mixed up.

“The voting papers are yours to sign. However, why were you writing “X” on those voting papers? “the bench asked, adding that the returning officer was only allowed to sign ballots by the rules. CJI Chandrachud stated, “It indicates you marked it.” The CJI stated that “this can’t be permitted in an electoral democracy” and therefore the returning officer must face legal action.

Supreme Court showed concerns about the horse-trading

The Supreme Court declared that it will review the ballots and the videotaped tallying on Tuesday. It has been requested that the returning officer appear in court.

After Masih ruled that eight votes cast by the AAP-Congress alliance were invalid, the Chandigarh mayoral elections became controversial and the BJP candidate won. The officer was charged by the opposition with manipulating the votes. Sonkar has stepped down, and three AAP council members have joined the BJP.

Chief Justice D Y Chandrachud, along with Justices JB Pardiwala and Manoj Misra, comprised the top court bench. “We are deeply concerned about the horse-trading which is taking place,” they declared. “We’ll list this tomorrow, review the ballots, and make a decision. The horse-trading industry as a whole is extremely unsettling. Tomorrow at noon, let’s also show the full video of the vote counting,” the CJI stated.

On 18 February, Manoj Sonkar resigned from his post of Mayor, one day before the court hearing on the ballot defacing and alteration.

    Actions backed by Godi Media

When the suspicion of Vote tampering was all over the internet. Godi media and it’s anchor were busy supporting and justifying the actions of Returning Officer Anil Masih.

Sushant Sinha, counted on live TV the number of marks Anil Masih put on ballot paper and yet the number came out to be 10 by Sushant. Whereas Anil Masih stated on the court room that he had marked 8 ballot papers.

Now people demands apology by the TV news anchor Sushant Sinha.

Rahul Gandhi to appear in court haulting Bharat Jodo Nyay Yatra for a day, Here’s why…

Tuesday’s Bharat Jodo Nyay Yatra will be put on hold once more as Congressman Rahul Gandhi is scheduled to appear in Sultanpur’s civil court about a defamation lawsuit that a BJP leader filed against him, according to party general secretary Jairam Ramesh.

“Rahul Gandhi has been summoned to appear in the Sultanpur District Civil Court tomorrow, February 20, in relation to a defamation action that was brought on August 4, 2018, by a representative of the BJP. As a result, the Bharat Jodo Nyay Yatra will stop tomorrow morning and resume on February 20 at 2:00 PM from Fursatganj in Amethi, according to a post made by Ramesh on X.

“The programme is proceeding as planned today, with Mallikarjun Kharge and Rahul Gandhi speaking at a public meeting in Babuganj, Amethi, at 4 PM,” he continued.

BJP leader Vijay Mishra filed a defamation lawsuit against Gandhi in 2018 after the latter was accused of making “objectionable” remarks about Union Home Minister Amit Shah during a news conference in Bengaluru. He was referring to remarks made by the Congressman that claimed the BJP was involved in a murder case when Amit Shah was the party president at the time.

In relation to a 2005 fake encounter case, Shah was cleared by a special CBI court in Mumbai four years before Gandhi’s confession. Shah was Gujarat’s Minister of State for the Home at the time.

  • Chandigarh Mayor Manoj Sonkar Resigns just before SC hearing

Chandigarh Mayor Manoj Sonkar Resigns just before SC hearing

Late last night, one day before the Supreme Court hearing regarding the claimed tampering in the mayoral election, BJP leader Manoj Sonkar announced his resignation as mayor of Chandigarh. Less than a month ago, on January 30, he defeated AAP’s candidate, Kuldeep Kumar in what was considered to be crucial election contest against the INDIA bloc.

Kuldeep Singh, the joint candidate of the Congress and AAP, managed to garner 12 votes, while the BJP managed to secure 16 votes. Eight votes that sparked a heated dispute between the opposition and the BJP were ruled void.

    Troubles arise for AAP

Three AAP council members, Poonam Devi, Neha, and Gurcharan Kala, joined BJP yesterday, so the party’s problems are far from over. After today’s additions, the BJP now has 17 council members out of the 35 members of the Chandigarh Municipal Corporation, up from its original 14 seats.

BJP also has the backing of one council member from the Shiromani Akali Dal, and Chandigarh MP Kirron Kher of the BJP is an ex-officio member with voting rights, bringing the BJP to the crucial 19 seats

With ten council members, the AAP currently leads its ally, Congress, with seven.

    Ballot altering and the evidence

Chaos erupted in the House shortly after the results were announced on January 30, with Congress and AAP council members accusing the BJP of electoral malpractice and cheating. They further claimed that in a video they later sent to the Supreme Court, presiding officer Anil Masih was seen “tampering” with voting papers. The BJP denied the allegation.

The Supreme Court had instructed both the ballots as well as the video of the election proceedings to be preserved after being horrified over the alleged altering of ballot papers and declaring that it was equal to a mockery of democracy. “Is this the conduct of an officer who is returning?” After watching a video of the ballot being counted, Chief Justice of India DY Chandrachud stated, “He is looking at the camera, and alters the ballot.”

Masih was the assigned council member, and the court has demanded that he appear on February 19. “Tight slap” for the BJP, is how the AAP and Congress defined the court’s observations. Following the presiding officer’s illness, the Chandigarh administration postponed the mayoral poll, which was initially slated for January 18 and was changed to February 6.

On January 24, the administration was instructed by the High Court to schedule the mayoral elections for January 30 at 10:00 a.m. The court referred to the election postponement order as “unreasonable, unjustified, and arbitrary” when it dismissed it.

Initially, the AAP had petitioned the Punjab and Haryana High Court for new elections overseen by a retired judge, but the court had denied them any temporary respite. Following his defeat in the Chandigarh mayoral election, Kuldeep Kumar challenged the High Court’s ruling in the Supreme Court.

  • Akhilesh Yadav alliance with Rahul when Congress accepts 17 seats

Akhilesh Yadav alliance with Rahul when Congress accepts 17 seats

As the time nears General Elections 2024, the INDIA alliance seems breaking apart. After Nitish resigned from INDIA Kejriwal gave no seats to the Congress in Delhi. Now Akhilesh has taken a new step that might shake the alliance between Congress and Samajwadi party in the upcoming elections.

In a recent official statement, Samajwadi Party chief, Akhilesh Yadav has offered Congress with 17 seats for contesting an election in Uttar Pradesh. This means the Samajwadi Party or any member of INDIA alliance will not be running their candidate from the particular seat and will assist Congress in defeating NDA from the allotted seats.

Will join Bharat Jodo Nyay Yatra only if our proposal is accepted

This is our final offer, according to SP sources. Akhilesh Yadav will accompany Rahul Gandhi on the Bharat Jodo Nyay Yatra if Congress approves of this. “We have made a final offer of 17 Lok Sabha seats to Congress,” stated Rajendra Chaudhary, chief spokesperson for the SP. Congress’s willingness to accept this offer will determine Akhilesh Yadav’s involvement in the Bharat Jodo Nyay Yatra in Rae Bareli.

The identities of the seats that are offered to Congress will be discoled on Monday. On Monday, the Gandhi-led Bharat Jodo Nyaya Yatra will arrive in Rae Bareli after passing through Amethi. Rahul’s Bharat Jodo Nyay Yatra in Rae Bareli is something the SP chief had previously declared he would participate in.

In an announcement released last night in Amethi, Congress announced that its president, Mallikarjun Kharge, would be in the city for the yatra. Previously, the state unit of the Congress party demanded more seats.

From 15 to 17 came the final offer of Samajwadi Party

Before this, Ajay Rai, the president of the State Congress, had stated that his party should be awarded roughly twenty seats, which it won during the 2009 Lok Sabha elections. The last time around, Congress had taken Rae Bareli, the only seat in Uttar Pradesh.

Uttar Pradesh has 80 seats in the Lok Sabha. Although Akhilesh Yadav’s schedule was set, he stated on Monday that we would not embark on the yatra until the seats were assigned to them. He had previously proposed 15 seats, but after Congress rejected his offer, the number was raised to 17.

Akhilesh Yadav already named 27 candidates, even before the Congress and themselves could agree on seats. Eleven more candidates have been declared by him after he first made public the list of 16 candidates. Afzal Ansari from the Ghazipur seat is one of them.

In addition, Akhilesh Yadav has announced candidates for seats in Chandauli, Gonda, Amla, Hardoi, and Bahraich. However, SP hasn’t made a decision about the Congress-dominated seats as of yet.

  • “Came to India 25 years ago, called it home” – French journalist Vanessa Dougnac on leaving India due to notice of ‘malicious reporting’

“Came to India 25 years ago, called it home” – French journalist Vanessa Dougnac on leaving India due to notice of ‘malicious reporting’

Vanessa Dougnac, a French journalist working in Delhi, departed the country on Friday, claiming she was being “forced to leave by the Government of India.” Last month, the Foreigners Regional Registration Office (FRRO) sent her a notice accusing her of ‘malicious’ reporting and requesting an explanation as to why her Overseas Citizen of India (OCI) status should not be revoked for purported rule violations.

In her 23 years as a journalist, Dougnac has covered a variety of topics, including the Maoist insurgency. She is married to an Indian national and was previously the South Asia Correspondent for La Croix, Le Point, Le Temps, and Le Soir.

Dougnac made the following statement in an evening statement on Friday: “Last month, I received a notice that claimed that my articles and were ‘malicious,’ harming ‘the interests of the sovereignty and integrity of India,’ and that I should explain why my OCI card should not be cancelled.’” My articles may “provoke disorder and disturb peace,” the notice continued.

Curbing Dissent from the OCI Community

She said, “I’m writing these words while crying. I’m leaving India today, the place I studied 25 years ago and have been a journalist for 23 years. The location I call home, is where I raised my son after getting married.” She said, “I am being forced to leave by the Government of India. I am not leaving by choice.” In her statement, she said, “I was denied permission to work as a journalist by the Ministry of Home Affairs sixteen months ago without any explanation or hearing.”

“Since then, I have repeatedly asked the Ministry to explain or review this arbitrary action, and they have never once replied. I have been wrongfully accused of undermining the state’s interests, which prevents me from working today. It is now obvious that I cannot continue to support myself while living in India. I fully trust the legal system and am contesting these allegations in the appropriate forums. However, I am unable to wait for its conclusion,” she remarked, adding that she hoped to return to India in the future. “I feel torn apart by the processes surrounding my OCI status, more so now that I realise they are a part of the Government of India’s larger attempt to silence the OCI community,” Dougnac stated.

She claimed that earlier, the authorities had advised her to change her line of work. She remarked, “But I am a journalist, a career I cherish, and I don’t want to stop because of unverified accusations.”

French Government attempted to get the resolved

When President Emmanuel Macron visited France for the Republic Day celebrations last month, France had actually brought up the Dougnac issue with India. The French side was informed by India that the matter had nothing to do with her journalism and had to do with “adherence to national laws and regulations.”

Vinay Kwatra, the foreign secretary, had stated that the proper government office was handling the matter, adding that it had been brought to their notice from the French side before and during President Macron’s visit.
