Muslim Man Declared Foreigner Despite Extensive Citizenship Evidence

The Gauhati High Court upheld a Foreigners' Tribunal order declaring an Assam resident, Aminul Hoque, a foreigner despite his submission of 15 documents proving his Indian citizenship, including the 1951 NRC. The court ruled that he failed to discharge the burden of proof under Section 9 of the Foreigners Act, 1946. Hoque argued that variations in family names across documents were minor clerical inconsistencies, but the tribunal found discrepancies in ages and family lineage, leading to his declaration as a foreigner.
