Navin Prakash Sentenced in Flat Purchase Cheque Bounce Case
In Jamshedpur, a court has convicted Navin Prakash, a builder and proprietor of Bharat Enterprise located in Sitramdera, in a cheque bounce case. The court sentenced him to one year of simple imprisonment. Additionally, the court ordered him to pay the complainant the remaining principal amount along with compensation.
According to the case details, Satyanarayan Singh, a resident of Bhuiyandih in Sitramdera, had given money to Navin Prakash for the purpose of purchasing a flat. The allegation is that despite receiving the amount, the builder neither constructed and handed over the flat nor returned the money for a long time. After considerable efforts and pressure, Navin Prakash agreed to return the money and issued a cheque of 1,150,000 rupees to Satyanarayan Singh.
However, when the cheque was presented at the bank for payment, it bounced. Following this, Satyanarayan Singh filed a case against Navin Prakash under Section 138 of the NI Act in the court. During the hearing of the case, a payment of 100,000 rupees was made by Navin Prakash, but the remaining amount was not paid. After the completion of the hearing, the court found Navin Prakash guilty under Section 138 of the NI Act.
In its order, the court directed Navin Prakash to pay the complainant the remaining principal amount of 1,050,000 rupees and 281,750 rupees as compensation. Along with this, the court also sentenced the accused to one year of simple imprisonment.
