The Gauhati High Court ruled that Talaq E Hassan is not prohibited and allowed a husband to register his divorce under the Assam Compulsory Registration of Muslim Marriages and Divorces Act, 2024. The court directed the jurisdictional Marriage and Divorce Registrar to verify the procedure's compliance. It noted Talaq E Hassan involves three pronouncements, with revocation possible after the first two if the couple reconciles. The petitioner pronounced talaq in 2026 after his wife left in 2018. The court said the wife can challenge the divorce in an appropriate forum.
